Regulation objectives

Corporate appointment - Macron Law Since the 1st of July 2016, a new regulation applies to companies established outside of France with detached employees and whose activities include land transport. This regulation concerns domestic road transport and international transport to or from France, but not simple transit operations.

The companies concerned are required to appoint a representative in France to act as a liaison with the national control authorities.

The regulation is designed to bolster the application of European posting rules, in order to protect drivers and shipping crews. For example:

Declaration of posting

This declaration must be established by the transport company via the French Labour Ministry website. It is valid for no more than 6 consecutive months and may cover several postings, without the need to detail these operations in advance.

Documentary obligations

Companies concerned by this directive are required to issue the following documents:

On board your vehicle

  • Declaration of posting
  • The work contract for the detached employee

For representatives in France

  • Declaration of posting
  • Pay slips for the period
  • The copy of the appointment of the representative in France
  • The name of the collective workers’ agreement applicable to the employee
